Criteria for the First Preference Employment-Based Category
for Aliens of Extraordinary Ability
The Immigration and Nationality Act provides for a fast-track route to permanent residence for individuals who have risen to the top of their field of endeavor. A petition under this "Extraordinary Ability" category is submitted to the U.S. Citizenship and Immigration Services with evidence of your having received a major internationally recognized award or at least three of the following:
1. Receipt of lesser nationally or internationally recognized prizes or awards for excellence in your field.
2. Membership in associations in your field which require outstanding achievements of their members, as judged by recognized experts in your field.
3. Evidence of your authorship of scholarly articles in your field, in professional journals, or other major media.
4. Published material in professional or major trade publications or major media about you and your work.
5. Evidence of your participation on a panel, or individually, as the judge of the work of others in your field.
6. Evidence in the form of letters and affidavits from prominent colleagues who can confirm your original scientific contributions of major significance to your field.
7. Evidence that you have been employed in a critical or essential capacity for organizations and establishments that have a distinguished reputation.
8. Evidence that you have commanded and now command a high salary or other compensation for services.
The U.S. Citizenship and Immigration Services currently processes this type of petition is approximately 10 months. If the petition is approved, you are your immediate family may file an application to adjust status to permanent residence with the USCIS or file an immigrant petition with the United States Consulate in your home country. |
